Ante Indicted for 17th DUI

Butler County Prosecutor Robin Piper announced today the indictment of Kevin Ante. Ante was indicted for Operating a Vehicle Under the Influence and Driving Under Suspension. These charges carry a maximum sentence of 10 years, 6 months.

On December 13, 2009, at 3:00 A.M., Defendant Ante was pulled over on Route 42 and Butler-Warren Road by the West Chester Police. Ante attempted to avoid police for a quarter-mile, before pulling over. The officer immediately noticed an odor of alcohol and that the defendant seemed somewhat confused or unresponsive. Ante is a 45-year old resident of Mason and has 16 prior convictions for driving while intoxicated. In 2006, Ante was convicted of a DUI with priors and sentenced to 4 years in prison. He was released in September 2009.

Ante is scheduled to be arraigned before the Honorable Michael J. Sage on Monday, December 21, 2009 at 8:30 AM. Assistant Prosecutor Jason Phillabaum presented the case to the Butler County Grand Jury and will be handling the case in Judge Sage’s courtroom.

In announcing the indictment, Prosecutor Piper stated, “We took this case direct to the Grand Jury to minimize the opportunity of Ante posting bond and getting out, particular during this holiday season, when many families will be on the road. We will be asking for a $500,000 bond on Monday.”

Piper went on to state, “Some people refuse to obey the law. Ante doesn’t just have a drinking problem. Ante could stay home and drink all he wants, but he insists on getting into a car and driving - endangering the safety and well-being of everyone on the road. If he doesn’t stop drinking and driving, we will just keep putting him back in prison and each time the sentence will be longer and longer. If we don’t keep Ante locked up, he’s going to kill someone someday.”
